FYI: Palestinian Minors Involvement in Terrorism and the Israeli Authorities Legal Framework and Statistics

State of Israel
Ministry of Justice
 General
Unfortunately, there are Palestinian minors who choose to take part in the armed struggle against Israel. For that purpose, they express their willingness to take part in suicide homicidal and other terrorist activities as described below.
Some of these Palestinian youth are recruited by Palestinian terrorist organizations through the promise that they will become martyrs ("shaheed") if they die during terrorist attacks. Most of the minors are recruited in order to commit suicide attacks which require fewer skills than shootings, infiltrations, etc.
Since the early years of the recent upspring (from 2000), the average age of suicide bombers has been gradually declining. In 2009, the most predominant activities characterizing involvement of minors were involvement in suicide bomb attacks, Molotov cocktails throwing, stone throwing and stabbing. During the recent years minors were also involved in grenades throwing, use of explosives, shooting, use of explosive cars, transfer of weapons, kidnapping of a person, rocket launching, as well as assault and murder
The Minority age in the West Bank
In accordance with international law, the Commander of the IDF forces in Judea and Samaria (hereinafter the "military commander") respects, unless absolutely prevented, the laws previously in force in the area under his authority, namely Jordanian law. According to the latter, a person becomes criminally liable at the age of 9. However, Jordanian law stipulates that a child under the age of 12 shall not be considered criminally liable unless it was proven that the child was able to understand the wrongful nature of his/her acts, at the time the crime was allegedly committed

Khaled Abu Toameh: What the U.S. Does Not Want to Know About Abbas
As U.S. Secretary of State John Kerry pursues his efforts to revive the peace process in the Middle East, Palestinian officials in the West Bank are complaining that Palestinian Authority President Mahmoud Abbas is keeping them in the dark and refusing to brief them about his plans.
For these officials, Abbas's autocracy has turned the Palestinian Authority into a one-man show called Mahmoud Abbas.
President Abbas has become the president of everything related to the Palestinians and the Palestinian cause, complained Sufyan Abu Zayda, a senior representative of Abbas's Fatah faction. He is the head of the PLO, President of Palestine, President of the Palestinian Authority, head of Fatah, and commander of the Palestinian Authority security forces.
Moreover, in the absence of a functioning Palestinian parliament, Abbas has taken it upon himself to issue his own laws.
MK: McDonalds Franchise Owner 'Defeatist Leftist'
MK Miri Regev (Likud) attacked fast food chain McDonalds' Israel franchise owner, Omri Padan, for his decision to boycott the city of Ariel because it is located on what he sees as “occupied territory.”
"Mr. Padan established Peace Now,” she said on Channel 10 Saturday night. “He is a leftist, he is a defeatist, he cannot make such a hypocritical and ugly decision.”

Can Islam Be Reformed?

History and human nature say yes

by Daniel Pipes
Commentary
July/August 2013

For an internet add-on, an excerpt about the Medieval Synthesis from my 1983 book, In the Path of God; Islam and Political Power, click here.
Islam currently represents a backward, aggressive, and violent force. Must it remain this way, or can it be reformed and become moderate, modern, and good-neighborly? Can Islamic authorities formulate an understanding of their religion that grants full rights to women and non-Muslims as well as freedom of conscience to Muslims, that accepts the basic principles of modern finance and jurisprudence, and that does not seek to impose Sharia law or establish a caliphate?

A growing body of analysts believe that no, the Muslim faith cannot do these things, that these features are inherent to Islam and immutably part of its makeup. Asked if she agrees with my formulation that "radical Islam is the problem, but moderate Islam is the solution," the writer Ayaan Hirsi Ali replied, "He's wrong. Sorry about that." She and I stand in the same trench, fighting for the same goals and against the same opponents, but we disagree on this vital point.
My argument has two parts. First, the essentialist position of many analysts is wrong; and second, a reformed Islam can emerge.

Fools Rush In Where Statesmen Fear to Tread

Barry Rubin

Washington DC

On the fourth anniversary of President Barack Obama's Cairo speech--setting the United States on a course of U.S.-backed Islamist revolutions in the Middle East, we've come a long way. Well, not so longer as it should have been. There has still not been anything close to an agonizing reappraisal of what has been done, said, and thought.
I am personally very happy because one of the world's leading Middle East experts helped me figure out what my task is. He explained: "You say what everyone else sensible thinks." So be it.

Several friends who work on the Middle East and have good sources of direct information in Congress and the government spontaneously told me that it is striking how clueless the Obama Administration officials and the foreign policy bureaucracy are about the Middle East. I think you would be shocked to hear about how little people know no matter which side the officials and experts are on. And I'm talking about people whose job it is to know about the region.

In professional intelligence circles, officers read things that conflict with the official line but most of them are scared about losing their jobs. They know what they are supposed to say. And it isn't the "I" word in any of its permutations.

French whistleblower throttled

Journalist sanctioned for revealing judges indulging in disorderly conduct.

PARIS. The French media usually have a soft spot for whistleblowers, people who reveal matters that the public is not supposed know about. Among recently celebrated leakers are the American soldier Bradley Manning who passed secret military information to WikiLeaks, Julian Assange and now Edward Snowden, who fled to Hong Kong after leaking information on American surveillance.

Not included in this celebrated group is French television journalist Clément Weill-Raynal, who works for the television station France 3. When on assignment to the offices of the Syndicat de la Magistrature, a left-leaning union of judges, a couple of weeks ago, he noticed that the judges had posted pictures of people they disliked on a huge bulletin board – labeled the Mur des cons, the Wall of Scumbags – complete with hostile graffiti against said scumbags.

The female president of the union indicated that the journalists must not film the bulletin board. Weill-Raynal nevertheless filmed the wall with his cell phone.

The 'Sex Jihad'

News emerged a few weeks ago in Arabic media that yet another fatwa had called on practicing Muslim women to travel to Syria and offer their sexual services to the jihadis fighting to overthrow the secularist Assad government and install Islamic law. Reports attribute the fatwa to Saudi sheikh Muhammad al-'Arifi, who, along with other Muslim clerics earlier permitted jihadis to rape Syrian women.
Muslim women prostituting themselves in this case is being considered a legitimate jihad because such women are making sacrifices—their chastity, their dignity—in order to help apparently sexually-frustrated jihadis better focus on the war to empower Islam in Syria.
And it is prostitution—for they are promised payment, albeit in the afterlife. The Koran declares that "Allah has purchased of the believers their persons [their bodies] and their goods; for theirs (in return) is the garden (of Paradise): they fight in His cause, and slay and are slain (Yusuf Ali trans. 9:111).
On the basis of this fatwa, several young Tunisian Muslim girls traveled to Syria to be "sex-jihadis." Video interviews of distraught parents bemoaning their daughters' fates are on the Internet, including one of a father and mother holding a picture of their daughter: "She's only 16—she's only 16! They brainwashed her!" pleads the father.

Obama and Kerry hypocrisy: Refusal to release Pollard while ask Israel to release another 107 convicted killers

Ma’an, the independent Palestinian news agency, reported this morning that secret talks are being held over the release of pre-Oslo prisoners. PA head Mahmoud Abbas has insisted that 107 Palestinians detained before the Oslo agreement must be released before the PLO will return to negotiations with Israel.

First a technical note: when PLO chief negotiator Saeb Erekat told Ma’an the release of prisoners detained before 1993 was part of the 1999 Sharm el-Sheikh memorandum and that Israel was obliged to abide by it he was a barefaced liar. And, I say barefaced liar because, unlike some of his Israeli counterparts, Erekat actually knows the text of the 1999 Sharm el-Sheikh memorandum, and that document in no way obligates Israel to release those prisoners. If Israel releases these terrorists it is because it decided to do it — not because it is obligated to.

Now let’s set the stage:

Here we are with U.S. Secretary of State John Kerry going on and on about how important and critical it is for Israel and the Palestinians to return to the negotiating table and how we Israelis have to make sacrifices. And, he is pushing us to release the 107 terrorists who carried out crimes against Israel more than two decades ago that were so despicable that they are still in prison today.

Nearing the tipping point

Politics may not be beanbag, but electoral politics is also not the game of basics that America needs today.  It is no longer realistic to speak of trying to win elections by means of dismissing basic issues like what liberty means, and whether government has grown so big that we really do have to transform it fundamentally.  There can be no such thing now as Republicans winning a national election by speaking as if we can remain on our current course without making major changes.

To speak so is to speak on the Democrats’ terms.  For all their talk of attacking the status quo, the Democrats are, today, the party of the status quo of law and government in America.  The status quo involves keeping the people trapped in a vise of regulation, taxes, and carefully calibrated “benefits.”  It involves funneling every problem of human life through government – but more than that, it involves making up fake problems in order to increase the power of government.  In today’s status quo, moreover, the federal government is as closely involved in local and personal issues as state and local governments are; there is no working principle that the federal government’s armed power should be kept separate from intricate economic regulation and moral law.

What is the motivation for USA actions?

Really?

Aching to Exercise: A Krav Maga Revolution

Thwack! Across the room, a female soldier is thrown to the hardwood floor by a much larger male soldier. She races up and readies herself before her opponent. Now he has the knife and it’s her turn. He lunges, and she parries the knife. In a flash, she’s now holding the weapon.
2nd Lt. Edi Halevi stands at the entrance to the gymnasium, her arms crossed, a look of satisfaction on her face. She’s responsible for the fitness of the mixed-gender infantry battalion, Caracal. Fresh off six months of active duty on the Egyptian border, Caracal is now participating in a three-day-long sports fair. Cycling, swimming – and for the first time for regular infantry – Krav Maga, are just some of the special exercises these soldiers took part in.
Behind the officer, male and female soldiers practice how to defend against an attacker with a knife. These aren’t the types of drills they are used to. Usually they wake well before sunrise, strap on large backpacks, combat vests and march with their rifles slung over their shoulders. Or maybe after a 16 hour day, they take part in a small exercise before bedtime. Today, they are dressed in civilian clothes, happily welcoming the opportunity to work out without being wrung out

Daniel greenfield on the weekend

The family member mentioned in previous roundups has come home from the hospital, but there is still a road ahead. It hasn't been an easy few weeks and I appreciate the understanding and support.

While I was distracted, I was apparently attacked by Paul Krugman, of all people.

Paul Krugman, who has done for economics what Erich Von Daniken did for space exploration, decided to attack me for the article while failing as badly at reading comprehension as he does at comprehending the existence of money.

Writing tongue-in-cheek, I mentioned that Bloomberg’s transportation commissioner Janette Sadik-Khan, the granddaughter of a Muslim Imam who worked with Hitler’s Mufti teaching SS men had, “In partial revenge… made many New York streets nearly as impassable as those of her grandfather’s wartime Dresden.”

You would have to be an idiot to take that at face value. Or Paul Krugman who headlined it as Nazi Islamic Bikes From Hell and called it “a wonderful window into the conservative psyche”.

When I was mentioned on Rush, I got emails telling me about it. But apparently no one around here reads Paul Krugman... which is a good thing.

Increase in NSA phone taps

The office collects the figures from federal and local jurisdictions at the request of Congress, but does not interpret the statistics. There is no explanation of why the federal figures increased so much, and it is generally out of line with the number of wiretaps between 1997 and 2009, which averaged about 550 annually. There was also a large number of wiretaps in 2010, when 1,207 were secured.

“This is just one more piece of evidence demonstrating the need for a full, informed public debate about the scope, breadth, and pervasiveness of government surveillance in this country,” Mark Rumold, a staff attorney at the Electronic Frontier Foundation, said in an e-mail. “We have a secret surveillance program churning in the background, sweeping in everyone’s communications, and, at the same time, in the shadows (and frequently under seal), law enforcement is constantly expanding its use and reliance on surveillance in traditional criminal investigations.”

The Justice Department did not respond to requests for comment.

Clearly the Boston Marathon jihad bomber was motivated by Islam. Clearly investigating Islam would illuminate the motives and goals of the Boston jihad bomber and others like him. Yet that is the one subject that is off-limits to investigators, on pain of charges of "Islamophobia."
"Feds: Boston Marathon suspect had bomb-making instructions, jihad literature available online," from the Associated Press, June 28:
BOSTON – What Dzhokhar Tsarnaev needed to learn to make explosives with a pressure cooker was at his fingertips in jihadist files on the Internet, according to a federal indictment accusing him of carrying out the bombings at the Boston Marathon that killed three people and injured dozens more.
Investigators have been trying to determine whether Tsarnaev's older brother, Tameran who was killed while the two were on the run after the bombing, was influenced or trained by Islamic militants during a trip overseas. But the indictment released Thursday against 19-year-old Dzhokhar makes no mention of any overseas influence.
Before the attack, according to the indictment, he downloaded the summer 2010 issue of Inspire, an online English-language magazine published by al-Qaida. The issue detailed how to make bombs from pressure cookers, explosive powder extracted from fireworks, and lethal shrapnel.

Keshet Chaim, which means the bow, or rainbow, of life, is an American-Israeli, not for profit, contemporary dance ensemble company, dedicated to teach the spirit of Israeli culture and Judaism. (http://www.kcdancers.org/)
Founded in 1983, Keshet Chaim presents original choreography which fuses contemporary Israeli dance with traditional Jewish folk dance from across the Diaspora, where Jews were dispersed. By using multi-ethnic Jewish culture roots Keshet Chaim combats prejudice and anti-Semitism through entertainment, community outreach, children's workshops, and professional development dance education, throughout the world.

Questions requiring informed responses

The Innocence of Islamic Jihad

I don't usually send out information on other peoples work, but this is an exception. There is a remarkably brave apostate from Islam, Imran Firastat. He lives in Spain and has produced a new movie about Islam:

"The Innocence of Islamic Jihad"

All this happened in the western world during last 2 months. Islamic Jihadists remain relentless and are intensifying their mission to destroy peace in the world. If they won't relent from Jihadi violence, what they believe is their sacred religious mission to subjugate the world to Islamic domination, then it is perfectly justified for us to investigate the source of their motivation and analyze the rights and wrongs of their mission. It is not only our constitutionally protected free speech right, but also the only way to cure the Jihadi menace that terrorizes the world today-East and West, North and South.

Understanding the underlying truth of Islamic Jihad, unsavory as it is, is essential for all peace-loving people of the world-whether Muslim or non-Muslim. Jihad is a doctrine enshrined in the sacred scriptures of Islam, which aims to establish the supremacy and domination of Islam over every inch of land on the earth through violence. For safeguarding our human rights and dignity, peace and prosperity, the ideology of violent Islamic Jihad has to be neutralized-more in an educational, peaceful and well-argued way. Military might won't kill an ideology; education and enlightenment will. Helping the world to understand the foundation and inner-workings of Islamic Jihad is not against the national security of any nation; instead, it is essential for safeguarding and strengthening national as well as global security and peace.

Stopping the Spread of Jihadist Islam in America: A Modest Proposal

by RICHARD BRODIE

http://www.familysecuritymatters.org/publications/id.9530/pub_detail.asp
Make no mistake about it. We are in the early stages of World War III with Islam. We know it is a war because the leaders in the Muslim world, with a philosophy of world conquest, have already declared it a war. Indeed, the early stages of war—intimidation and infiltration—are already well under way.
The West’s initial reaction to this threat has been denial, much as it was in the 1930s to the rise of Nazi Germany. How, it is asked, can a gaggle of third-world nations with fanatical medieval origins threaten the mighty West, just as they wondered in the 1930s how there could be a threat from a militarily defeated Germany from World War I!

US foreign policy is failing worldwide.

The Russian and Chinese embrace of indicted traitor Edward Snowden is just the latest demonstration of the contempt in which the US is held by an ever increasing number of adversarial states around the world.

Iran has also gotten a piece of the action.

As part of the regime's bread and circuses approach to its subjects, supreme dictator Ali Khamenei had pretend reformer Hassan Rohani win the presidential election in a landslide two weeks ago. Rohani has a long record of advancing Iran's nuclear program, both as a national security chief and as a senior nuclear negotiator. He also has a record of deep involvement in acts of mass terror, including the 1994 bombing of the AMIA Jewish center in Buenos Aires that killed 85 people and wounded hundreds.

Daniel Greenfield article: Bike Lanes to Nowhere

Link to Sultan Knish

Posted: 27 Jun 2013
The streets of Manhattan are full of smiling white yuppies riding their Citibank bikes, blue lights flashing as they sail through midtown traffic. But the great rack of bike share bikes planted next to a housing project is filled with its cargo of blue vehicles. No one is checking them out here. Instead black kids sit on the locked bikes, occasionally fitfully pedaling them, going nowhere.
The contrast is an apt metaphor for the city. The smiling kids who could just as easily be cashing checks from their parents and working at an ad agency while trying to pay off their student debts in Portland, San Francisco or Seattle. They happen to be doing it in New York City and they expect the same social amenities, the retro bars, the craft beers, the obscure bands and the bike lanes.

The street ahead has been dug up and water has been turned off to half the block. The operation has no other purpose than to turn two lanes of traffic into some kind of complex curved sidewalk on a street where there is hardly any foot traffic and you can wait two minutes to see a single pedestrian during the daylight hours.

"He who tells the truth is driven from nine villages."--  Turkish proverb

By Barry Rubin
Has it become time that the absurd paradigm governing the Israel-Palestinian and Arab-Israeli conflict as well as the “peace process” be abandoned or challenged?
After all, this narrative has become increasingly ridiculous. Here is what is close to being the official version:
The Palestinians desperately want an independent state and are ready to compromise to obtain that goal. They will then live peacefully alongside Israel in a two-state solution. Unfortunately, this is blocked either by: a) misunderstanding on both sides or b) in the recent words of the Huntington Post, “the hard-line opponents who dominate Israel's ruling coalition.” Israel is behaving foolishly, too, not seeing that, as former President Bill Clinton recently said, Israel needs peace in order to survive. One aspect—perhaps a leading one—why Israel desperately needs peace is because of Arab demographic growth. The main barrier to peace are the Jewish settlements.

Israel is NOT under threat Mr. Kerry

Secretary Kerry, Demography Doesn't Threaten the Jewish State!
by Jeff Jacoby, The Boston Globe

Israel is "running out of time," Secretary of State John Kerry told the American Jewish Committee in Washington this month. A two-state solution to the Palestinian conflict must be reached soon or "the insidious campaign to de-legitimize Israel will only gain steam," he warned. "Israel will be left to choose between being a Jewish state or a democratic state, but it will not be able to fulfill the founders' visions of being both at once."
It's an old refrain, erroneous but popular: Israel must make peace with the Palestinians — "peace" being defined as the creation of a 22nd Arab state — before high Arab birthrates turn the Jews into a minority in their own land.
In Jerusalem a few months ago, President Obama echoed the same claim.
"Given the demographics west of the Jordan River," he said, "the only way for Israel to endure and thrive as a Jewish and democratic state is through the realization of an independent and viable Palestine."
This so-called "demographic argument" may sound compelling, even ominous. But it rests on an obsolete stereotype of Arab women as baby mills, outbreeding their Jewish sisters at such a pace that it is only a matter of time before Jews are numerically overwhelmed on the land between the Jordan River and the Mediterranean.

FBI Faces of Global Terrorism Ad - Blocked by CAIR
The U.S. government has long offered rewards for its most wanted terrorists as a way of incentivizing people to be on the lookout. Its success obviously relies upon widespread knowledge of the award and what the terrorists look like.
For the Council on American-Islamic Relations (CAIR), a U.S. Muslim Brotherhood entity, the fact that Americans would become aware that majority of the most-wanted terrorists are Islamic extremists compelled it to take action. As usual, CAIR cried “Islamophobia,” deployed its interfaith partners and was successful in having the most-wanted terrorist ads taken down.

Morning Bell: The House of Second Chances

The farm bill died in the House—but could it live again?
House Majority Leader Eric Cantor (R-VA) is reportedly pushing to split up the old farm bill and take food stamps out of it.
The Heritage Foundation has argued that it didn’t make sense to combine the bloated food stamp program with farm-related programs in the first place. It is supposed to be the “farm” bill, after all. And with food stamp costs doubling under President Obama, it’s a program that deserves a careful look on its own.
Splitting up the bill is the first step toward reforming both food stamp and farm spending. In a new paper, Heritage experts Daren Bakst and Rachel Sheffield write that “The House now has a second chance to pass a farm bill that benefits taxpayers, farmers, and food stamp recipients.”
PIEchart_NewRecipe
It’s incredibly important, they point out, that the House does not add costly new programs to existing farm policy, which already imposes major costs on taxpayers and drives up food prices.

Trouble times for the MB

The Arab and Islamic world is headed for an explosion, and Israel must defend itself from the shrapnel that will fly in every direction.

The following article was written in Hebrew by Dr. Mordechai Kedar for the June 28, 2013 issue of the Makor Rishon newspaper, and translated to English by Sally Zahav.

The Muslim Brotherhood is Headed for a Blow-up

by Mordechai Kedar

Opposition movements usually get public support and encouragement from the masses because they challenge a corrupt and oppressive regime. This public support is what brings the opposition movement to power, either by democratic means or by violence. At first, the public is content because it it sure that its preferred movement, which used to be the opposition, will behave fairly and democratically towards the public when it comes to power. But the moment the opposition movement gets to sit behind the steering wheel it becomes a controlling elite, and it is now responsible for imposing law and order on the residents. It is also expected to supply all of the public's needs - food, drinking water, employment, health services, infrastructure, and a hope that their situation in the future will be better than in the past.

The tragedy that opposition movements frequently experience is that they often lack the skills necessary to manage a state. This is because during the period while they were engaged in the struggle to wrest power from the previous regime, they were not building up the experience they would need in order to rule effectively. But once they are in power, they must provide solutions for problems that were created, for the most part, by the previous regime. And when the new regime needs to levy taxes and impose discipline on the residents, the citizens begin to see it the same way as the previous regime that was overthrown by the opposition. Since the new regime usually does not have magic solutions for the population's problems, it finds itself, after a short time, a regime with dwindling legitimacy, especially if its leaders exploit the privilege of their position. Power, as we all know, corrupts.
